Terms and Conditions

Please read these conditions carefully prior to making a booking. The terms are limited to Diamond on the Island and do not apply to terms and conditions in relation to any other person or company whose services are used by you or your party on any holiday.

Making a booking
The completed booking form, showing the names of all persons on whose behalf you are making a booking must be completed and signed by the party leader. The person signing the booking form confirms that he/she has the authority of all other persons included on the booking form to make the booking on their behalf and that he/she has read and accepted these booking conditions. A NON-REFUNDABLE deposit of $500 per week for each property booked is required at the time of booking. For bookings of holiday periods, deposit amounts may vary. Deposits are accepted as partial payment towards the total cost of the holiday. On receipt by Diamond on the island of your completed booking form and deposit, we will reserve your holiday. Only one discount is allowed per reservation unless the owner authorizes the second discount. It is important to check the details on the invoice and that all the dates are exactly as you requested. The Diamond on the Island responsibility is to provide you with the holiday you have booked as confirmed to you and subject to these booking conditions. If you want to cancel or change your booking you may have to pay amendment or cancellation costs.

Security deposits
A security deposit is usually not required. Credit card information will be taken to ensure the owner has an option in the event of property damages or to replace missing items.

Paying the balance
Balances are payable in full 60 days before check-in. For bookings within 60 days of check-in, the total rental amount is payable in full at the time of booking. If payment of the balance of the price of the holiday is not received by Diamond on the Island by the due date, Diamond on the Island reserves the right to cancel the booking for the holiday in which case Diamond on the Island is entitled to keep all deposits paid in respect of the holiday. The Diamond on the Island reserves the right to raise or lower its prices at any time before you book the holiday. Prices may vary and you should make sure you have been quoted the latest price. You will be advised at the time of booking. Once you have booked and confirmation has been sent, the price of the holiday is guaranteed except that Diamond on the Island may pass on to you, and you will have to pay, any tax, duty, levy or any increase in such tax, duty or levy that is charged by any government or other authority after the date your booking is confirmed and accepted.

Payment Options
We prefer payment by check, either personal or bank. We will accept payment by credit card or PayPal; however, the processing fee of 4% must be paid by the renter.

Front Door Access
Use the code provided to unlock the front door. If the unlock process fails, call the owner to obtain the code for the lockbox on the wall with the key in it. Please return the key to the lockbox immediately after using it. In the unlikely event you lock yourself out; there will be a $60.00 service fee during normal business hours. The fee increases if it is after normal business hours.

Upon Check-in
Please inspect the home, garage and grounds. Call the owner at 908.369.6540 with any concerns or damages you notice. Please leave a message if there is no answer. We will return your call as soon as possible.

Changes by Diamond on the Island
All descriptions are made in good faith and every care is taken to ensure their accuracy and advertised facilities, amenities, entertainment and schedules may on occasion be restricted, curtailed, changed or cancelled. In these circumstances, we will, if possible, notify you of such changes. Advertised facilities may vary from those published. We will always try to advise you in advance of any changes before the holiday begins but cannot accept any liability to changes by owners or management companies to advertised facilities for property or accommodation.

Cancellation by you
Your cancellation can only be accepted if it is in writing or by email from the person who completed the booking form. Cancellation will be effective from the date it is received and acknowledged. You may cancel your booking at any time. Cancellation charges will apply as follows: Cancellations more than 60 days before the arrival date will forfeit the deposit. If cancellation is made between 6 and 8 weeks before the arrival date, 50% of the full fee will be forfeited. If cancelled between 4 and 6 weeks, 75% of the full fee will be forfeited. Cancellation within 4 weeks of the arrival date will result in full forfeiture of the total rental fee.

Guest Responsibilities
It is the responsibility of all persons listed on the party details form to ensure that all equipment and furnishings within the home are treated with respect and due care. It is the guests responsibility to ensure that the Security Alarm System is used whenever the home is left unoccupied and that all windows and doors are locked. Failure to follow these requirements will result in the guests being liable for losses as a result of burglary. Any spillages on carpets or furnishings must be cleaned immediately. It is expected that on your departure day all furnishings will be left in a reasonably clean condition.

Damaged or missing items
The home will be inspected after your departure. Any damaged or missing items will be identified. We will advise you of any charges that may arise as a result of the inspection. The credit card on file will be charged appropriately.

General conditions
We cannot accept liability for acts or omissions over which we have no control. This includes (but is not limited to) airlines, car hire companies, management companies and for loss or damage caused by Force Majeure events such as strikes, fire, flood, delays or any other events beyond our control. Instructions and deposits taken by telephone and verbally confirmed are binding and will be subject to the same terms and conditions as written confirmations. All guests will be responsible for behaving in a responsible manner and in accordance with local regulations. The Diamond on the Island or the property owners cannot accept any liability for injury to guests or visitors to the homes or by use of swimming pools or for loss or damage to personal property howsoever caused. Check in time is 4 pm. Check out time is 10 am. Earlier check-in or late check-out is fully dependent on availability. Signing of the booking form constitutes acceptance of the terms and conditions on behalf of the party booked. All persons must be shown on the booking form. No pets or animals are allowed on or in the premises.

Complaints Procedure
If you have a complaint while you are on holiday, call the owner at 908.369.6540 immediately. He will do his best to resolve any problem.

Pool/Spa Water Heating
If the guest elects to pay for either Pool Water Heating or Spa Water Heating, we will endeavor to ensure that the pool water temperature is maintained at a minimum of 80 degrees and the spa water will be heated to at least 100 degrees. However, these temperatures CANNOT be guaranteed as the air temperature is a major factor in the pool water. The pool heater cannot heat the water if the outside temperature is below 55 degrees. Should the equipment used to heat the water of filter it fail in one way or another, we will do everything we can to correct the situation. If we cant correct the problem, we will refund a fair portion of the price we have charged for the service. Pool covers MUST be removed carefully before swimming and replaced IMMEDIATELY AFTER USE to help conserve heat and maintain the desired pool water temperature.

Code of Conduct
Emerald Island Resort is a premier community and it is the guests responsibility to ensure that all community rules are followed and that gusts behavior does not inconvenience your neighbors in any way. The Emerald Island Resort community requires that minimal noise occurs between 10:00 pm and 7:30 am. The maximum speed limit is 10 mph. In the event of any disturbance, you may be requested to leave the property and forfeit all monies paid.

Force Majeure
Force Majeure means any circumstances which are unusual or unforeseeable and are outside of our control including (but not limited to) war or threat of war, riot, civil strife, hostilities, political unrest, government action or airport regulations, industrial dispute, natural or other disaster, nuclear incident, terrorist activity, weather conditions, technical problems with transportation, closure of airports, fire, flood, drought, temporary equipment failure in villas, apartments or hotels.
